Hirer Terms & Conditions
Terms for hirers working with Brooks’s Bookings
These terms set out the basis on which venues, businesses, event organisers and private clients may book Artists through Brooks’s Bookings. Please read them carefully before confirming a booking.
1. About Brooks’s Bookings
Brooks’s Bookings is an entertainment booking agency that connects Hirers with Artists for live performances at venues, events and other occasions.
Brooks’s Bookings assists with finding suitable Artists, coordinating booking arrangements, confirming agreed booking details and administering payments for bookings made through the agency.
For the purposes of these Terms, “Hirer” means the individual, business, venue, organisation or other person making the booking, and “Artist” means the performer or performing act booked through Brooks’s Bookings.
Brooks’s Bookings acts as an intermediary between the Hirer and Artist and does not itself provide the Artist’s live performance.
2. Making a Booking
Hirers may submit a booking enquiry to Brooks’s Bookings through the website, by email or through another communication method offered by Brooks’s Bookings.
When making an enquiry, the Hirer should provide accurate information about the proposed event, including the date, venue or location, event type, required performance times, preferred type or style of Artist, approximate budget and any relevant requirements.
Submitting a booking enquiry does not create a confirmed booking and does not guarantee that a particular Artist will be available.
Brooks’s Bookings will use the information provided by the Hirer to identify and contact potentially suitable Artists.
Where an Artist is available and interested in the booking, Brooks’s Bookings will communicate the proposed Artist, performance fee and relevant booking details to the Hirer.
The Hirer is responsible for checking that the booking details provided to Brooks’s Bookings are correct and for notifying Brooks’s Bookings of any important requirements before the booking is confirmed.
A booking will only become confirmed once the relevant booking details and price have been agreed and Brooks’s Bookings has issued confirmation of the booking.
Hirers should not make arrangements on the assumption that an Artist has been secured until confirmation has been received from Brooks’s Bookings.
3. Artist Selection and Availability
Brooks’s Bookings will use the information provided by the Hirer to identify Artists who may be suitable for the event.
When suggesting an Artist, Brooks’s Bookings may consider factors including the type of event, location, performance requirements, musical style, budget, Artist availability and any preferences communicated by the Hirer.
Artists joining the Brooks’s Bookings network may be asked to provide performance material, set lists and other relevant information as part of the application and review process.
While Brooks’s Bookings aims to recommend suitable Artists, individual preferences are subjective and Brooks’s Bookings cannot guarantee that every Artist will meet every Hirer’s personal musical preferences.
Hirers should review any Artist information, performance material or other details provided before agreeing to proceed with a booking.
An Artist’s availability may change until a booking has been formally confirmed. An Artist should therefore not be considered secured solely because Brooks’s Bookings has suggested them or confirmed that they are initially available.
Where a Hirer requests a particular Artist, Brooks’s Bookings will make reasonable efforts to arrange the booking but cannot guarantee that the requested Artist will be available.
If a requested Artist is unavailable, Brooks’s Bookings may offer suitable alternative Artists where possible.
4. Booking Confirmation
A booking will only be considered confirmed once Brooks’s Bookings has confirmed the booking to the Hirer in writing.
Before confirmation, the Hirer will be provided with the relevant booking details, which may include the Artist, event date, venue or location, performance times, agreed performance fee and any specific requirements agreed for the performance.
The Hirer is responsible for reviewing the booking details and notifying Brooks’s Bookings promptly if any information is incorrect.
Once the booking has been confirmed, the Hirer and Artist will be expected to honour the agreed arrangements, subject to the cancellation and amendment provisions contained in these Terms.
Any significant changes requested after confirmation — including changes to the date, venue, location, performance times, performance duration or nature of the event — must be communicated to Brooks’s Bookings and may require the Artist’s agreement.
Brooks’s Bookings cannot guarantee that an Artist will be able to accommodate changes requested after a booking has been confirmed.
Hirers should communicate material booking arrangements through Brooks’s Bookings rather than making separate arrangements directly with the Artist, except where Brooks’s Bookings has agreed that direct communication is appropriate.
Any additional services, extended performance times or other requirements not included in the original confirmed booking may result in an additional charge, which will be agreed before the additional service is provided.
5. Fees and Payment
The total price for each booking will be agreed with the Hirer before the booking is confirmed.
Booking confirmation payment:
To secure and confirm a booking, the Hirer must pay 10% of the total agreed booking price to Brooks’s Bookings.
The booking will not be considered fully confirmed until the required 10% confirmation payment has been received by Brooks’s Bookings, unless otherwise agreed in writing.
Remaining balance:
The remaining 90% of the agreed booking price must be paid no later than 7 days before the scheduled performance date.
Brooks’s Bookings may issue payment reminders, but it remains the Hirer’s responsibility to ensure payment is received by the applicable deadline.
If the remaining balance is not received by the payment deadline, Brooks’s Bookings may contact the Hirer and may suspend or cancel the booking where payment remains outstanding. Any cancellation resulting from non-payment will be dealt with in accordance with the applicable cancellation provisions of these Terms.
Payment to Brooks’s Bookings:
All payments relating to bookings arranged through Brooks’s Bookings must be made to Brooks’s Bookings using the payment method provided. Hirers should not make payment directly to the Artist unless Brooks’s Bookings has expressly agreed otherwise in writing.
Any additional performance time, services or other changes that result in an additional charge must be agreed before the additional charge becomes payable.
Brooks’s Bookings will provide appropriate confirmation or records of payments received in relation to the booking.
6. Cancellation by the Hirer
The Hirer must notify Brooks’s Bookings as soon as reasonably possible if they wish to cancel a confirmed booking.
More than 14 days before the performance:
The Hirer may cancel the booking and the 10% booking confirmation payment will be refunded, subject to any applicable statutory rights and these Terms.
Between 7 and 14 days before the performance:
The Hirer may cancel the booking, but the 10% booking confirmation payment will normally be retained.
Less than 7 days before the performance:
The Hirer may cancel the booking, but the 10% booking confirmation payment will normally be retained. No additional cancellation fee will be charged solely because the cancellation occurs within 7 days.
Brooks’s Bookings will keep an appropriate record of late cancellations for the purpose of managing the reliability of Hirers using its services.
Repeated late cancellations:
Where the same Hirer cancels three confirmed bookings with less than 7 days’ notice, Brooks’s Bookings may review the Hirer’s continued use of its services.
Following that review, Brooks’s Bookings may temporarily suspend the Hirer from making new bookings or, in serious or repeated circumstances, decline to accept future bookings from that Hirer.
Any decision will take into account the circumstances and reasons for the cancellations, including genuine emergencies or circumstances outside the Hirer’s reasonable control.
These cancellation provisions do not affect any statutory rights available to the Hirer.
7. Cancellation by the Artist
If an Artist is unable to fulfil a confirmed booking, Brooks’s Bookings will notify the Hirer as soon as reasonably possible after becoming aware of the cancellation.
Brooks’s Bookings will make reasonable efforts to find a suitable replacement Artist who can provide a comparable performance for the event.
Where a suitable replacement is available, Brooks’s Bookings will provide the Hirer with relevant information about the proposed replacement before making the change.
The Hirer will not be required to accept a replacement Artist who is materially different from the type of performance originally booked.
Where the Hirer accepts a replacement Artist:
The booking will continue with the replacement Artist. If the replacement costs the same as the original booking, there will be no change to the agreed price.
If the replacement Artist has a lower performance fee, the Hirer will receive an appropriate reduction or refund of the difference.
Brooks’s Bookings will not charge the Hirer more than the originally agreed booking price for a replacement Artist unless the Hirer has been informed of the additional cost and expressly agrees to it.
Where no suitable replacement can be found:
If Brooks’s Bookings cannot provide a suitable replacement Artist, the Hirer may cancel the affected booking and will receive a full refund of all amounts paid for that booking, including the 10% booking confirmation payment.
Where the Hirer reasonably declines the proposed replacement:
Where the replacement would materially differ from the agreed performance and the Hirer reasonably chooses not to proceed, Brooks’s Bookings will provide a full refund of amounts paid for the affected booking.
Brooks’s Bookings will not knowingly substitute an Artist merely for convenience where the originally booked Artist remains able and willing to perform.
Nothing in this section affects any statutory rights available to the Hirer.
Brooks’s Bookings will prioritise finding a replacement before cancelling the booking wherever reasonably possible.
8. Changes to a Booking
Once a booking has been confirmed, the Hirer must notify Brooks’s Bookings as soon as reasonably possible of any requested change to the agreed booking arrangements.
Changes may include the event date, venue or location, performance start or finish time, performance duration, event type, required set-up time or other significant performance requirements.
Brooks’s Bookings will discuss the requested change with the Artist and will make reasonable efforts to accommodate it.
A material change to a confirmed booking will not take effect until it has been agreed by the relevant parties and confirmed by Brooks’s Bookings.
Changes to performance times: Minor timing adjustments may be accommodated where reasonably possible. Significant changes are subject to the Artist’s availability and agreement.
Change of venue: If the event is moved to another venue or location, the Hirer must inform Brooks’s Bookings before the change is confirmed. Additional travel or other reasonable costs may apply where the new location materially changes the Artist’s requirements. Any additional amount will be communicated to and agreed with the Hirer before becoming payable.
Change of date: A request to move the performance to another date will be treated as a request to amend the existing booking. Brooks’s Bookings will check whether the Artist is available for the new date.
If the Artist is available and all parties agree, the booking may be transferred to the new date.
If the Artist is unavailable for the requested new date, Brooks’s Bookings may offer a suitable alternative Artist where possible. If the Hirer chooses not to proceed with an available alternative, the circumstances will be reviewed to determine whether the request should be treated as a cancellation under Section 6 — Cancellation by the Hirer.
Additional performance time or services: Where the Hirer requests additional performance time or services beyond those originally agreed, an additional fee may apply. The Hirer will be informed of the additional cost and must agree to it before the change becomes binding.
Brooks’s Bookings will not materially change the agreed booking price, Artist or performance arrangements without informing the Hirer and obtaining agreement where required.
All material booking changes should be confirmed in writing.
9. Hirer and Venue Responsibilities
The Hirer is responsible for providing Brooks’s Bookings with accurate and complete information about the event, venue and performance requirements before the booking is confirmed.
Suitable performance area:
The Hirer must ensure that the Artist is provided with a suitable, safe and reasonably accessible area in which to set up and perform.
Health and safety:
The Hirer must inform Brooks’s Bookings of any known health and safety risks at the venue or event that could reasonably affect the Artist or their performance, together with any measures in place to manage those risks.
Access and set-up:
The Hirer must ensure that the Artist is given reasonable access to the venue in sufficient time to unload equipment, set up and carry out any agreed sound check before the performance.
Electricity and facilities:
Where electrical power or other facilities are required for the performance, the Hirer must ensure that suitable and reasonably safe facilities are available as agreed before the booking.
Equipment:
The Hirer must provide any equipment, PA system, staging or other facilities that they have specifically agreed to provide as part of the booking. Equipment that the Artist is responsible for providing will be identified as part of the booking arrangements.
Licences and permissions:
The Hirer or venue is responsible for ensuring that the event and premises have any licences, permissions or approvals that are legally required for the event and live performance, where these are their responsibility.
Audience and conduct:
The Hirer must take reasonable steps to provide a safe environment for the Artist. Threatening, violent, abusive, discriminatory, sexually inappropriate or seriously disruptive behaviour towards an Artist will not be tolerated.
Outdoor performances:
Where an Artist is booked to perform outdoors, the Hirer must provide suitable protection from unsafe weather conditions and appropriate protection for the Artist and electrical equipment where required.
Parking, travel and access requirements:
Any agreed parking, accommodation, travel expenses or special access arrangements should be confirmed with Brooks’s Bookings before the booking is confirmed.
Changes or problems:
The Hirer must notify Brooks’s Bookings as soon as reasonably possible if they become aware of anything that could materially affect the Artist’s ability to perform safely or fulfil the agreed booking.
Where the venue or event conditions present a serious or immediate safety risk, the Artist will not be required to perform or continue performing while that risk remains. Brooks’s Bookings will review the circumstances of any such incident before determining the effect on the booking or payment.
10. Artist Performance and Requirements
The Artist will provide the performance described in the confirmed booking details, including the agreed performance duration, approximate performance times and type of performance.
Performance times and set lengths:
The Artist will perform for the agreed amount of time. Where a performance consists of multiple sets, reasonable breaks may be required between sets and should be agreed as part of the booking arrangements.
Song requests:
Hirers may submit song or music requests before the performance. Artists will make reasonable efforts to accommodate requests where appropriate, but specific songs cannot be guaranteed unless they have been expressly agreed as part of the confirmed booking.
Additional performance time:
The Hirer should not expect the Artist to perform beyond the agreed performance duration without prior agreement. Requests for additional performance time may be subject to Artist availability and an additional fee.
Late-running events:
Where an event is running late for reasons outside the Artist's control, the Artist will make reasonable efforts to accommodate the revised timing. However, the Artist will not automatically be required to extend their agreed finish time or performance duration.
Equipment and technical requirements:
The booking confirmation should identify any significant equipment or technical requirements and, where applicable, whether these will be provided by the Artist, Hirer or venue.
Artist repertoire:
Artists retain reasonable control over their set list and performance style, subject to any specific requirements agreed before the booking and the need to provide a performance suitable for the event.
Breaks and background music:
Any requirement for background music, playlists or music during Artist breaks should be agreed before the booking and should not be assumed to be included unless confirmed.
Changes on the day:
Hirers should not require the Artist to make substantial changes to the agreed performance on the day of the event. Any significant request should be discussed with Brooks’s Bookings and may require the Artist's agreement.
Brooks’s Bookings will provide the Artist with relevant information obtained about the booking, including the location, expected hours, nature of the performance and any known health and safety risks or requirements.
11. Direct Contact and Bookings
Brooks’s Bookings invests time and resources in identifying Artists, introducing them to Hirers and arranging performance opportunities.
Hirers must not knowingly attempt to bypass Brooks’s Bookings for the purpose of avoiding the booking arrangements or fees applicable to a booking that has been introduced or arranged through Brooks’s Bookings.
Where Brooks’s Bookings introduces an Artist to a Hirer, bookings arising from that introduction should normally continue to be arranged through Brooks’s Bookings while the applicable agency relationship or booking arrangements remain in place.
If an Artist introduced through Brooks’s Bookings contacts the Hirer directly about arranging a further performance outside Brooks’s Bookings, the Hirer should notify Brooks’s Bookings before confirming the arrangement.
Hirers may communicate directly with Artists where reasonably necessary for practical matters relating to a confirmed performance, such as arrival, access, set-up or other arrangements, where Brooks’s Bookings permits or facilitates that contact.
Direct communication between a Hirer and Artist does not by itself transfer responsibility for managing or administering a booking away from Brooks’s Bookings.
Nothing in this section prevents a Hirer from engaging other Artists whom they have found independently and who were not introduced to them through Brooks’s Bookings.
Any restriction, fee or other consequence relating to the direct engagement of an Artist introduced through Brooks’s Bookings will apply only where permitted by applicable law and where it has been clearly agreed in the relevant terms.
12. Problems, Complaints and Incidents
Brooks’s Bookings aims to provide a professional and reliable booking service. If a Hirer experiences a problem relating to an Artist or a confirmed booking, they should notify Brooks’s Bookings as soon as reasonably possible.
Problems before the performance:
If an issue arises before the event, the Hirer should contact Brooks’s Bookings as soon as possible so that reasonable steps can be taken to resolve the matter before the performance.
Problems during the performance:
Minor practical issues may, where appropriate, be raised politely with the Artist or relevant venue representative at the time. Significant issues should also be reported to Brooks’s Bookings as soon as reasonably possible.
Complaints following a performance:
Hirers wishing to make a formal complaint should provide Brooks’s Bookings with sufficient information to investigate the matter, including the booking concerned, what happened and any relevant supporting information or evidence.
Brooks’s Bookings will review the complaint and may request further information from the Hirer, Artist, venue or other relevant parties.
Where a complaint concerns an Artist’s conduct or performance, the Artist will normally be given a reasonable opportunity to provide their account of what happened before Brooks’s Bookings reaches a decision.
Serious incidents:
Threatening, violent, discriminatory, sexually inappropriate or otherwise seriously unacceptable behaviour towards an Artist, Hirer, venue representative or other person may result in the booking being stopped where reasonably necessary for safety.
Where there is an immediate risk to health or safety, the individuals involved should prioritise their safety and contact the appropriate emergency services where necessary.
Possible outcomes:
Depending on the circumstances, Brooks’s Bookings may take reasonable steps including discussing the matter with the parties, arranging an appropriate resolution where possible, issuing a warning, reviewing an Artist or Hirer’s continued use of Brooks’s Bookings, or taking other proportionate action.
A complaint does not automatically entitle the Hirer to a full or partial refund. Any refund or other financial remedy will depend on the circumstances, the service actually provided and the Hirer’s applicable legal rights.
Nothing in this section limits any statutory rights available to the Hirer.
13. Photography, Video and Promotional Use
Brooks’s Bookings may occasionally request photographs or video footage from performances arranged through its service for use in promoting Brooks’s Bookings and its Artists.
Where Brooks’s Bookings wishes to take, obtain or use photographs or videos for promotional purposes, appropriate permission will be obtained where required.
Promotional photography or video consent is optional and is not a condition of making a booking through Brooks’s Bookings.
Where the Hirer agrees to provide Brooks’s Bookings with photographs or videos from an event, the Hirer should only provide material that they are entitled to share and should consider the privacy and rights of identifiable individuals appearing in that material.
Brooks’s Bookings may use approved photographs or videos on its website, social media accounts and other promotional materials in accordance with the permissions obtained.
Particular care should be taken where photographs or videos include children or other individuals whose permission may be required. Brooks’s Bookings may decline to publish material where appropriate permissions cannot be established.
Brooks’s Bookings will not guarantee that photographs or videos submitted by a Hirer, Artist or venue will be published.
Where Brooks’s Bookings relies on consent for promotional use, that consent may be withdrawn. Brooks’s Bookings will then take reasonable steps to stop future use and remove the material from digital channels under its control where appropriate, although it may not always be possible to withdraw material already incorporated into previously produced or published materials.

14. Events Outside Our Control
Brooks’s Bookings, the Artist and the Hirer will not be treated as being at fault where a booking cannot reasonably proceed because of circumstances genuinely outside the affected party’s reasonable control.
Such circumstances may include severe or dangerous weather, major travel disruption, venue closure, power failure, fire, flood, serious accident, emergency, government restrictions or other exceptional events that could not reasonably have been prevented or avoided.
The affected party must notify Brooks’s Bookings as soon as reasonably possible after becoming aware that such circumstances may prevent or significantly affect the performance.
Where possible, Brooks’s Bookings will work with the Hirer and Artist to find a reasonable solution. This may include delaying the performance, changing the performance arrangements, rescheduling the booking or arranging a suitable replacement Artist, depending on the circumstances.
Any material change or rescheduled date must be agreed by the relevant parties.
Where circumstances genuinely outside the parties’ reasonable control make it impossible for the performance to proceed and a reasonable alternative or rescheduled date cannot be agreed, Brooks’s Bookings will review the booking and any payments already made in accordance with applicable law and the circumstances of the cancellation.
Brooks’s Bookings will not rely on this section where the failure to provide the agreed service resulted from something that Brooks’s Bookings could reasonably have prevented or where Brooks’s Bookings failed to take reasonable steps to minimise the effect of the problem.
Nothing in this section limits any statutory rights available to the Hirer.
15. Liability
Brooks’s Bookings will provide its booking and intermediary services with reasonable care and skill.
Brooks’s Bookings will take reasonable steps to coordinate confirmed bookings and communicate relevant information between the Hirer and Artist.
Brooks’s Bookings will not normally be responsible for loss or damage resulting from circumstances outside its reasonable control or from the acts or omissions of the Hirer, venue or other third parties where Brooks’s Bookings was not at fault.
Artists are responsible for providing their agreed performance and for their own conduct, equipment and performance materials. However, this does not remove any responsibility Brooks’s Bookings may have where Brooks’s Bookings itself has failed to provide its services with reasonable care and skill.
The Hirer is responsible for ensuring that information supplied about the event and venue is accurate and for meeting the responsibilities set out in these Terms.
Brooks’s Bookings will not normally be responsible for losses that were not reasonably foreseeable when the booking was made or that were not caused by a breach of these Terms by Brooks’s Bookings.
Where a problem occurs, Brooks’s Bookings will take reasonable steps to help resolve the matter, including communicating with the Artist and Hirer and, where appropriate, considering replacement, rescheduling, refund or another reasonable remedy.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, or removes any statutory rights available to a Hirer.
16. Data Protection and Privacy
Brooks’s Bookings may collect and use personal information about Hirers where necessary to respond to enquiries, arrange and administer bookings, process payments, communicate with Hirers and Artists, manage complaints or cancellations, maintain appropriate business records and provide its services.
Personal information will be handled in accordance with applicable data protection law and the Brooks’s Bookings Privacy Policy.
Hirers are responsible for ensuring that the information they provide to Brooks’s Bookings is accurate and should notify Brooks’s Bookings if relevant booking or contact information changes.
Brooks’s Bookings may share relevant booking information with the Artist, venue, payment providers or other parties where reasonably necessary to arrange, administer or fulfil the booking.
Brooks’s Bookings will only collect and use personal information where there is an appropriate lawful basis for doing so and will not retain personal information for longer than reasonably necessary for the purposes for which it is held.
Where promotional photography or video is involved, this will be handled in accordance with Section 13 — Photography, Video and Promotional Use and the Brooks’s Bookings Privacy Policy.
Hirers can find further information about what personal information Brooks’s Bookings collects, why it is used, who it may be shared with, how long it is retained and their data protection rights in the Privacy Policy.
17. Changes to These Terms
Brooks’s Bookings may update these Terms from time to time where reasonably necessary to reflect changes to its services, business practices or legal and regulatory requirements.
Changes to these Terms will not retrospectively alter the agreed terms of an existing confirmed booking unless the Hirer agrees to the change or the change is required by law.
Where a proposed change materially affects an existing booking, Brooks’s Bookings will communicate with the Hirer where appropriate.
The latest version of these Terms will be available on the Brooks’s Bookings website.
18. Governing Law and Jurisdiction
These Terms and any booking made through Brooks’s Bookings will be governed by the laws of England and Wales, subject to any mandatory legal rights that apply to the Hirer.
If a dispute arises, Brooks’s Bookings and the Hirer should first make reasonable efforts to resolve the matter directly through communication and the complaints process set out in these Terms.
Nothing in these Terms prevents a Hirer from exercising any right they may have to bring legal proceedings in a court with jurisdiction to hear their claim.
Nothing in these Terms limits or removes any statutory rights available to a consumer.
19. Contact and Acceptance of Terms

Before a booking is confirmed, the Hirer will be required to confirm that they have read and agreed to these Hirer Terms & Conditions.
By confirming a booking, the Hirer agrees to comply with the booking, payment, cancellation and other obligations contained in these Terms.
Acceptance of these Terms may be recorded electronically, including through an online booking form, email confirmation or other electronic method.
Hirers should retain a copy of the Terms applicable to their booking. Brooks’s Bookings will maintain appropriate records of confirmed bookings and the terms applicable to them.
